Silver lining

At the very least (barring a "J'accuse!" post by the folks at blackboxvoting.org), the shenanigans that everyone predicted haven't happened, and we'll have a real result.

On the gripping hand, if Bush takes Ohio and Kerry takes everything else still in play, we have the Nightmare Scenario of 269-269 and 4-4 on SCOTUS. Great Mother grant that that doesn't happen!

Well, the one bit of good news in that "nightmare senario" is that the SCOTUS has nothing to do with it if it's a 269-269 tie. The bad news is that the House of Represenatives does, and that almost assuredly means a Bush victory.

They shouldn't have had anything to do with it last time. The Constitution is pretty clear; disputed electoral votes preventing either candidate from making a majority should have sent it to the House of Representatives.

That would have been a political disaster for the Republicans, though, so the court took the bullet for them. Unfortunately, since the Court is now somewhat overtly just another partisan arena. That is, IMO, bad.
